1. Introduction
These Terms of Service govern your access to and use of www.thebarkingcat.com (the "Site"), operated by The Barking Cat, a partnership firm registered in India. When we use "we", "us", "our" or "The Barking Cat" in these Terms, we refer to that firm. By accessing or using our Site, placing an order, or creating an account, you agree to be bound by these Terms, along with our Privacy Policy, Refund Policy and Shipping Policy, all of which are incorporated by reference. If you do not agree to these Terms, please do not use our Site.
Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order on our Site. If you are under this age, you may only use our Site with the involvement of a parent or legal guardian, who will be responsible for the order and for reviewing these Terms on your behalf.

If you create an account with us, you are responsible for maintaining the confidentiality of your login credentials and for all activity that takes place under your account. Please notify us immediately at contact@thebarkingcat.in if you suspect any unauthorised use of your account.

All content on this Site, including the name "The Barking Cat", our logo, graphics, product designs, photography, videos and written content, is the property of The Barking Cat or its licensors, and is protected under applicable copyright, trademark and intellectual property laws. You may not reproduce, distribute, modify or create derivative works from any content on this Site without our prior written permission. Any unauthorised use of our brand name, logo or product designs, including counterfeiting or reproduction for resale, will be pursued to the fullest extent permitted under law.
4. Products, pricing and availability
All prices listed on our Site are in Indian Rupees and are inclusive of applicable Goods and Services Tax, unless stated otherwise for a specific promotion. We reserve the right to change prices, discontinue products or limit order quantities at any time without prior notice. We make reasonable efforts to display our products and their colours, materials and details accurately, though slight variations may occur due to screen display settings or the handcrafted nature of certain techniques, and such variations do not constitute a defect. In the event a product is listed at an incorrect price due to a technical or clerical error, we reserve the right to cancel the order and issue a full refund, even if the order has already been confirmed.
5. Orders and contract formation
Placing an order on our Site constitutes an offer to purchase the relevant product. A contract of sale is formed only when we confirm and dispatch your order, not when you place it or receive an automated order confirmation email. We reserve the right to refuse or cancel any order for reasons including product unavailability, suspected fraud, or errors in pricing or product information. You may cancel your order at any time before it is dispatched for a full refund, in line with our Refund Policy.
6. Payment
All payments on our Site are processed securely through our payment partner, Razorpay. We do not store your card, UPI or banking details. By placing an order, you confirm that the payment information you provide is accurate and that you are authorised to use the payment method selected.

Shipping timelines, charges and other delivery related terms are set out in our Shipping Policy, which forms part of these Terms.
8. Returns, exchanges and refunds
All returns, exchanges and refunds are governed by our Refund Policy, which forms part of these Terms.
9. Third party links
Our Site may contain links to third party websites, including our social media pages or payment and logistics partners. We are not responsible for the content, policies or practices of any third party website, and including a link does not imply our endorsement of it.
10. Disclaimer of warranties
Our Site and products are provided on an "as is" and "as available" basis. While we take care to ensure our products meet the quality standards described, we do not warrant that our Site will be uninterrupted, error free or completely secure. To the maximum extent permitted by applicable law, we disclaim all warranties, whether express or implied, other than those that cannot be excluded under the Consumer Protection Act, 2019 or other applicable Indian law.
11. Limitation of liability
To the maximum extent permitted by applicable law, The Barking Cat shall not be liable for any indirect, incidental or consequential loss arising from your use of our Site or products. Our total liability in connection with any order shall not exceed the amount you paid for that order. Nothing in these Terms limits any liability that cannot be excluded under applicable Indian consumer protection law, or under mandatory consumer protection law applicable to customers in the European Union.
Indemnification
You agree to indemnify and hold harmless The Barking Cat, its partners and employees from any claim or demand arising out of your misuse of the Site or your violation of these Terms.
12. Grievance Officer
In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Act, 2000, our Grievance Officer is Sarthak, THE BARKING CAT COMPANY, Building No./Flat No. B55A, Phase VII, Focal Point, Near Chpora Industries, Ludhiana, Punjab, 141010, India.

13. Governing law and dispute resolution
These Terms are governed by the laws of India. Subject to your statutory rights as a consumer in your own jurisdiction, any dispute arising out of or relating to these Terms or your use of our Site shall be subject to the exclusive jurisdiction of the courts at Ludhiana, Punjab, India. If you are a consumer located in the European Union or United Kingdom, nothing in this clause takes away any mandatory consumer protection rights or dispute resolution mechanisms available to you under the law of your own country of residence.
14. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date, and continued use of our Site after such changes constitutes your acceptance of the revised Terms.
